1) Agreement

These Terms govern your access to and use of Listenery ("we", "us", "our") and the website and services (the "Service"). By using the Service, you agree to these Terms. If you're using the Service on behalf of a company, you confirm you have authority to bind that company.

2) The Service

Listenery helps you run and analyze user interviews and research. The Service may change over time. We may add, remove, or modify features to improve quality, security, or compliance.

3) Accounts & security

You're responsible for maintaining the confidentiality of your account and credentials, and for all activity under your account. You must provide accurate information and keep it updated.

4) Acceptable use

You agree not to (a) break the law, (b) interfere with or disrupt the Service, (c) attempt to access non-public areas, (d) reverse engineer the Service except to the extent prohibited by law, (e) upload malware, or (f) use the Service to infringe the rights of others.

5) Your content & permissions

You retain ownership of the content you upload or create in the Service ("Customer Content"), including interview prompts, recordings, transcripts, and research outputs. You give us a limited license to host, process, and display Customer Content only as needed to provide and improve the Service.

If you collect data from participants (including recordings/transcripts), you are responsible for obtaining all required consents and permissions and complying with applicable privacy laws.

6) Third-party services

The Service may integrate with third-party services (for example: hosting, analytics, email, transcription/AI providers). These services may have their own terms and policies. We are not responsible for third-party services.

7) Pricing, payments & taxes

Pricing is shown on our Pricing page and may change. Payments may be processed by Paddle (our payments partner / merchant of record, depending on your location). Taxes may be added based on your billing location and local regulations.

If you purchase interview credits (e.g., 50 interviews), those credits are tied to your account. If we introduce subscriptions in the future, renewal terms will be shown clearly at checkout.

8) Refund policy

You can request a refund within 14 days of purchase by emailing support@listenery.ai. We'll approve refunds if you've used 10 or fewer interviews.

If you've used more than 10 interviews, we typically can't refund because of AI processing costs. If there's a clear product issue on our side, we'll handle it fairly.

Approved refunds go back to the original payment method and may take a few business days to appear.

9) Intellectual property

We own the Service and all related software, designs, and trademarks, other than Customer Content. You may not copy, modify, distribute, sell, or lease any part of the Service unless we give you written permission.

10) Service availability

We aim for reliable uptime, but the Service is provided on an "as is" and "as available" basis. Maintenance, outages, or changes may occur.

11) Disclaimers

The Service may use AI to generate questions, follow-ups, summaries, or insights. Outputs can be inaccurate or incomplete. You are responsible for reviewing outputs and how you use them.

12) Limitation of liability

To the maximum extent permitted by law, Listenery will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill.

Our total liability for any claim relating to the Service will not exceed the amount you paid to us for the Service in the 3 months before the event giving rise to the claim.

13) Termination

You can stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if needed for security or legal reasons.

14) Changes to these Terms

We may update these Terms from time to time. If changes are material, we'll take reasonable steps to notify you. Continued use of the Service after changes means you accept the updated Terms.

15) Governing law

These Terms are governed by the laws of India. Courts located in Bengaluru, Karnataka will have jurisdiction.
